Conflict situations in medical practice: ethical and legal aspects

Abstract

The paper analyzes the causes that contribute to the development of conflict situations in medicine and ways to solve them. Currently, there is a high prevalence of neuropsychiatric di­sorders in patients with somatic pathology, which leads to the deve­lopment of psychological maladaptation and increases the risk of conflict situations. Characteristic features of modern society, such as constant tension, stress, overwork, lack of time, over-awareness, along with the prevailing adverse socio-economic factors, the manifestations of which is increasing every year in our country, is accompanied by an increase in neuropathies and psychopathies of the population, which makes society more aggressive and complicates the interaction of medical workers with patients, which leads to an increase in the frequency of conflict situations. In cases of their occurrence, the psychological readiness of the doctor to ma­nage the conflict is most important. Communication skills with patients deepen professional flexibility. In conflict situations, one of the most common methods for diagnosing personality behavior in these cases with the aim of eliminating it is the two-dimensional Thomas-Kilmann conflict mode instrument, which includes indicators of attention to the interests of the partner and to own interests. The most effective ways out of conflicts are cooperation and compromise. A significant moment in the occurrence of the “doctor-patient” conflicts is the growing dissatisfaction of society with the quality of medical care. The development of civil society and the growth of civic literacy of the population led to the growing activity of patients in the field of protecting their rights. Therefore, conflict prevention is relevant, and in cases of their occurrence — a constructive solution. The main direction of conflict prevention is to increase the legal culture with the development of active models of doctor’s behavior in accordance with current socio-economic conditions and legal civil acts. Thus, the most effective method of preventing conflict is to prevent its occurrence.
